Acceptance and eligibility
These Terms of Service (the “Terms”) form a binding agreement between you and Xiaomi Crowd Trading Limited (the “Company,” “we,” “us”), the operator of the platform branded as Xiaomi Crowd Trading (the “Platform”). The Platform is sponsored by Xiaomi Technology and operated in partnership with the World Food Programme, Oxfam International, the China Development Research Foundation, and the Dongao Education Group (each a “Sponsor”).
By creating an account, accessing the Platform, or using any of the services, you confirm that:
- you are at least 18 years old (or the minimum age required by your jurisdiction, whichever is higher);
- you have the legal capacity to enter into these Terms;
- you are accessing the Platform from a jurisdiction in which we are authorized to provide services; and
- the information you provide during registration is accurate, current, and complete.
If you do not agree to these Terms, do not use the Platform. If you are using the Platform on behalf of a business or organization, you represent that you have authority to bind that entity, and “you” refers to that entity throughout.
The platform and services
The Platform is a unified consumer surface that brings three distinct services together under a single verified wallet:
- Investment brokerage
- Access to foreign exchange, equities, and crypto-asset markets, executed through licensed broker and custodian partners. We do not self-custody or self-match orders; all execution is routed.
- eCommerce
- Purchase of Xiaomi-ecosystem products, vehicles, and curated partner merchandise, fulfilled by the Company or by authorized third-party sellers. Wallet balance is the sole in-platform settlement source.
- Crowdfunding (“Lift”)
- Contributions to humanitarian and educational programmes operated by our Sponsors. A transparent share of Platform revenue, plus your direct contributions, is disbursed under quarterly audited agreements.
We may add, change, or remove features at any time. We will make reasonable efforts to give advance notice of material changes that affect existing user assets or balances.
Account registration and KYC
You must register an account to use most Platform features. We operate a tiered identity-verification model ( “KYC”):
- Level 1 — email, phone, and basic identity. Permits browsing, contributions up to USD 200, and most eCommerce transactions in supported jurisdictions.
- Level 2 — government photo ID and biometric selfie liveness check, processed by our identity-verification providers (currently Persona and Sumsub). Required for all trading activity, withdrawals, and contributions above USD 200.
- Level 3 — proof of source of funds, employment, and tax-residency confirmation. Required for elevated limits and institutional features.
You agree to provide accurate verification information and to promptly update it if it changes. We may screen you against sanctions lists, politically-exposed-person registers, and other regulator-mandated watchlists. We may suspend or refuse service at our reasonable discretion if verification cannot be completed or if a match is detected.
Your account is personal and non-transferable. You are responsible for maintaining the confidentiality of your credentials. If you suspect your account has been compromised, contact support@xiaomicrowdtrading.com immediately.
Wallet, custody, and settlement
Every account holds a single multi-currency wallet (the “Wallet”). The Wallet is the sole in-platform settlement source: trades, purchases, and contributions debit the Wallet; external payment rails (cards, Alipay, WeChat Pay, bank transfer, crypto on-ramp) only fund the Wallet and never settle a transaction directly.
Your fiat funds are held in segregated client-money accounts with regulated custodian partners and are not on the Company’s balance sheet. Crypto assets are held by a licensed institutional custodian with a cold/hot split designed to minimize key-exposure risk. Custodian identities are published in our Security & Custody disclosure.
We maintain a double-entry ledger of every Wallet movement. Statements and a year-end activity summary are available from your account dashboard. Reconciliation against custodian records is performed daily; any unresolved discrepancy will be raised to you within five business days of discovery.
Withdrawals require step-up authentication and may be subject to velocity limits, regulator-required holds, and travel-rule data collection.
Investment brokerage
Trading services are provided through licensed broker partners. You may place market, limit, stop, stop-limit, take-profit, stop-loss, trailing-stop, and one-cancels-the-other orders, subject to product and jurisdiction availability.
You acknowledge and agree that:
- order routing decisions, slippage, and partial fills are functions of the underlying market and the broker’s execution policy;
- leverage, where offered, is capped according to jurisdictional rules and may be reduced unilaterally during volatile market conditions;
- paper-trading sandboxes do not replicate live-market liquidity and are intended for educational purposes only;
- copy-trading features carry risk disclosure overlays that you must review before enrollment;
- we may halt, restrict, or unwind any order in response to a regulator instruction, fraud signal, or material market event.
Nothing on the Platform is investment advice, a recommendation, or a solicitation. You alone bear the consequences of your trading decisions.
eCommerce and product purchases
Purchases settle from your Wallet at the displayed price. Taxes, duties, and shipping fees are itemized at checkout. Final price is the amount displayed on the order confirmation.
Returns, refunds, warranties, and dispute resolution for hardware purchases follow the policy published in our Returns Centre. For Xiaomi-branded electronics and vehicles, manufacturer warranty terms apply in addition to your statutory consumer rights. Crowd-buy and group-buy campaigns may have specific cancellation windows; these are disclosed on the campaign page before you commit.
Title and risk pass on delivery unless local consumer law dictates otherwise. Shipping is provided by carrier partners; estimated delivery windows are not guaranteed.
Donations and the Lift programme
The Lift programme channels a transparent share of Platform revenue, plus your direct contributions, to programmes operated by our Sponsors. Funds disbursed through Lift are not refundable once allocated.
Contributions are not tax-deductible by default. Where a partner programme offers tax-deductible giving in your jurisdiction, the partner provides the receipt; the Company does not issue charitable tax documentation.
We publish a public Impact Ledger that lists every disbursement to a partner programme, including date, partner, programme, amount, and measured outcome. Quarterly impact reports are independently audited and available from the Lift dashboard.
Your responsibilities
You agree to:
- provide accurate information at registration and keep it current;
- use the Platform only for lawful purposes consistent with these Terms;
- safeguard your credentials, biometric tokens, and recovery factors;
- review confirmations and report unauthorized activity within 30 days of the relevant statement;
- pay all taxes that may be owed on your gains, purchases, contributions, or other taxable events;
- comply with the laws of every jurisdiction from which you access the Platform.
Prohibited uses
You must not, and must not attempt to:
- use the Platform for money laundering, terrorist financing, sanctions evasion, fraud, or any other illegal purpose;
- impersonate another person or misrepresent your identity, source of funds, or tax residency;
- manipulate markets, spoof, layer, wash-trade, front-run, or otherwise abuse trading services;
- scrape, reverse-engineer, automate, or interfere with the Platform’s normal operation outside of public APIs;
- resell, sublicense, or commercially exploit any portion of the Platform without our written permission;
- upload viruses, malware, or content that infringes third-party rights;
- use the Platform from a jurisdiction in which we are not authorized to operate, or via any technical measure intended to disguise your true location.
We reserve the right to investigate suspected violations and to share information with law-enforcement and regulatory authorities as legally required.
Fees, taxes, and currency
Current trading spreads, deposit and withdrawal fees, FX conversion rates, and any other charges are published on our Pricing page and may change with reasonable notice. We do not charge inactivity or account-maintenance fees.
You are solely responsible for any taxes, levies, or duties that apply to your transactions. The Company may withhold or report transaction information to tax authorities where required. Trading proceeds used to fund eCommerce or Lift contributions may constitute a taxable disposal under your local tax rules.
Multi-currency conversions are quoted at the mid-market rate plus the spread published at the time of conversion.
Risk acknowledgments
Financial products carry risk. By using the Platform you acknowledge that:
- the value of investments can go down as well as up, and you may lose more than you invest where leverage is used;
- crypto-asset prices are highly volatile and the underlying technology is novel and evolving;
- past performance is not a reliable indicator of future results;
- liquidity may not be available at all times for all instruments;
- partner programmes funded through Lift are operated by independent organizations, and we do not guarantee specific outcomes.
A full, jurisdiction-specific risk disclosure is presented and acknowledged during sign-up and is incorporated into these Terms by reference. The current version is available at /legal/risk.
Intellectual property
The Platform, the Xiaomi Crowd Trading brand and trade dress, and all associated software, designs, content, and trademarks are owned by the Company, its Sponsors, or its licensors. You are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes consistent with these Terms.
You retain ownership of content you submit (such as product reviews and support attachments) but grant the Company a worldwide, royalty-free licence to host, display, reproduce, and distribute that content for the purpose of operating and improving the Platform.
Third parties and sponsors
The Platform integrates services provided by independent third parties, including broker partners, custodian partners, payment processors, identity-verification providers, shipping carriers, and Sponsor programmes. Their services are governed by their own terms and policies, which you may be asked to accept separately.
We do not control, endorse, or warrant the conduct or content of third-party services. Sponsors do not endorse specific trades, products, or contributions; their sponsorship is of the Platform as a whole, not of any particular user activity.
Suspension and termination
We may suspend, restrict, or terminate your account at any time, with or without notice, if:
- you breach these Terms or any other policy referenced here;
- verification information is missing, inaccurate, or cannot be confirmed;
- required by law, regulator order, or court order;
- continued service would expose the Company, other users, or third parties to undue risk.
You may close your account at any time from your account settings, subject to the orderly resolution of open positions, pending settlements, and obligations to Sponsors. Provisions that by their nature should survive termination — including disclaimers, indemnification, dispute-resolution, and liability limitations — will survive.
Disclaimers and limitation of liability
To the maximum extent permitted by law, the Platform and the services are provided on an “as is” and “as available” basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by law, the Company, its directors, officers, employees, and Sponsors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of the Platform — including loss of profits, loss of trading opportunity, market movement, or data loss — whether based on contract, tort, statute, or any other legal theory, and whether or not we were advised of the possibility of such damages.
Where liability cannot be excluded by law, our total aggregate liability for any claim arising out of or in connection with these Terms is limited to the greater of (a) the fees you paid to us in the twelve months preceding the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless the Company, its Sponsors, and their respective directors, officers, employees, agents, and licensors from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the Platform, or (c) your violation of any law or third-party right.
Governing law and disputes
These Terms are governed by the laws of Hong Kong SAR, without regard to its conflict-of-laws principles. The parties agree to the exclusive jurisdiction of the Hong Kong International Arbitration Centre (HKIAC) for the binding arbitration of any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights.
The arbitration will be conducted by a sole arbitrator in English, seated in Hong Kong, under HKIAC Administered Arbitration Rules in effect at the time of filing. Nothing in this section limits any mandatory consumer-protection right available to you in your country of residence.
Changes to these terms
We may update these Terms from time to time. The current version is always available at this URL with an effective date and version number. Material changes will be notified to you by email or by in-product banner at least 30 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms; if you do not agree, you may close your account before the effective date without penalty.
